Lucy v. Zehmer Case Brief Essay

I. Statement of the Facts Zehmer owned a Farm that Lucy had made several offers to purchase, all of which Zehmer rejected. Lucy met Zehmer in the latter’s restaurant one evening. Lucy filed a lawsuit against Zehmer to compel him to transfer the title of the farm to him for $50,000. The trial court ruled in favor of Zehmer. Lucy appealed to the Supreme Court of Appeals of Virginia. II. Issue Does the offer made by Zehmer – supposedly as a joke – constitute a valid contract? III. Rule of Law â€Å"The first requirement for effective offer is a serious intent. Not determined by subjective intentions, beliefs and assumptions of the offeror. Rather it is determined by what a reasonable person in the offeree’s position would conclude that the offreror’s words and actions meant.† Offers made in jest, obvious anger, or undue excitement do not count and the acceptance of them does not create an agreement. IV. Analysis In his defense, Zehmer claimed that the offer to sell his farm to Lucy was made as a joke and at the time he made it they were both drinking and he was not in a state of sobriety. The court judged Zehmer’s argument about his mental state inconsistent due to the fact he was able to provide great detail what was said and done that night in his testimony. The court found that the contract was discussed for forty minutes, rewritten to include Mrs. Zehnmer, and she did sign it. The discussion of what to be included in the sale and the provisions of it made a serious transaction. The delivery of the written contract shows a good faith offer and a good faith acceptance.

HDI for Cameroon has been studied only for the years 1980, 1990, 2000 and 2010 since data for other years are not available. However, for Egypt, Ethiopia and Uganda the GDP growth in 1992 has been positive. Among these countries, Cameroon shows the lowest level of GDP growth. In fact the HDI has improved for all these countries in the beginning of the twenty first century. ... These factors also help in correlating the drivers of human development, and thus poverty alleviation in these countries. The data shows that the GDP of Egypt shows declining trend after 1998 and that of Uganda falls consistently after 2006. Although, in Egypt, GDP growth reached a local high in 2007, it has been decreasing consistently since then. Figure: GDP growth of Egypt and Uganda This shows that there are certain factors that have affected the overall productivity in these countries. However, surprisingly level of HDI growth has improved in both countries after 2003. Sufficient information for HDI for both Egypt and Uganda has not been available for the years before 1999. Therefore, HDI in the countries during these years could not be compared. Figure: HDI growth of Egypt and Uganda This is a sharp increase and HDI has remained high since then without fluctuating. This reveals that although GDP is commonly considered the measure of growth, for many developing countries it does not reflect the true level of development of the economy. Hence, human development index should be considered while studying the level of economic development for these countries. In the analysis section, I have studied the level of openness to trade of the countries that display the most contrasting features. The contrasting characteristics of the two countries, Uganda and Cameroon, make it important to make an in depth study of the factors affecting the economic activities of these countries. For many people, culture still completely dictates their way of life, as is evident in many religions, such as Hinduism, where the line between religious traditions and everyday life is blurred. Culture and language are so intricately intertwined that even trained scholars find it impossible to decide where language ends and begins, or which one of the two impacts the other the most (189). Without language, culture would be, as Trueba stated, virtually non-existent, as certain emotions can only be conveyed in certain languages. The same holds true for language, as it is often impossible to translate texts while retaining the same literary and emotional connotations the original version contained because certain words only exist in those languages. Moreover, language, especially in literature, leaves much up to interpretation, and translations often omit any ambiguity that the author may have originally intended. When searching for English versions of Fyodor Dostoyevskys Crime and Punishment, several versions are available, each translated by different individuals. In each of these books, differences can be observed in the way the plot is described, though they seldom make any difference in the larger scheme. Even the spelling differs (e. g. Dunya and Dounia) simply because of the way the translator thought the word sounded phonetically. By the same token, reading a Tang dynasty poem in Chinese differs greatly from the English translation. Though the English version manages to retain most of the poets original message, it lacks the fluidity and the poetic essence that can be found in the same poem in Chinese. As with all subjective issues, language is subject to interpretation, and to take away a literary works original language is to deduct from the piece as a whole. Knowledge, however, is not, as Trueba described, acquired solely through culture and language. It is not necessary for language to exist in order for us to know that fire is hot, or that water is wet. Though we may not be able to place these feelings with these specific words, we know that they exist because our sense of touch tells us so. If I chose to call fire water, the flames would still burn my hand when I touched it even if I had attributed a word that would normally extinguish the flames to it. By doing so, I have not changed the entity I have renamed, but have simply categorized it under a different label. A baby does not need to know the meaning of the word hot in order to know that a burning stove is extremely warm to the touch, or the meaning of the word light in order to know that it is brighter in the day than it is at not. After all, a rose by any other name would be just as sweet (Shakespeare, Romeo and Juliet). Ever since ancient days, culture and language have played integral roles in defining an individual and dictating ones everyday life. The morals that we live by are directly related to our cultural values, which are evident in ancient texts, such as the Koran, Bible and Torah. These books, however, have been translated so many times that their meaning has no doubt been at least slightly changed. In the Jewish culture, the Torah must be recited in Hebrew, the original language of the Jews. In this instance, Hebrew is much more than just a language; it also symbolizes the religious beliefs and customs of the Jewish people, and in this way, much of their traditional culture can be retained. Likewise, Catholics conduct Mass in Latin (though it is not as common anymore) and like in Judaism, much of the culture is maintained that way as well. Language leads directly to culture and culture to language in a cyclical process so that the boundaries between the two become virtually nonexistent. By the same token, language (be it English, Russian, Greek or Japanese) would differ greatly from what we know today if culture were to cease to exist. Much of culture as we know it would be lost without language, as it would be next to impossible to carry on cultural traditions from generation to generation without a means of communication. Much of the vocabulary accumulated in languages is a direct result of cultural practices, traditions and innovations. Each time a new revolution in society or technology takes place, a string of new words is developed. It is estimated that a few dozen new words are added to the English language alone each year. 1 Common words such as television, Internet, and telephone would have meant nothing two short centuries ago. The word silhouette only came into existence after the French Minister of Finance under Louis XV, Etienne de Silhouette, began decorating his office with cheap, black paper cutouts. As culture develops, language, too, must evolve to accommodate the new changes as people feel the need to identify objects and feelings with words. A persons way of utilizing language can also tell a lot about his/her cultural background. For someone raised in a normal urban environment, the word Negro will have a very meaning as opposed to the individual who had grown up in the Ku Klux Klan. For the urban New Yorker, Negro would be a derogatory and offensive term that should never be used. For the Klan member, however, the term would equate to ignorant and degraded and altogether sold to the devil. Likewise, the word woman could be considered a derogatory insult depending on the context it is used in. For many women in this modern era, if a man were to say Hey woman, get over here and help me with this, it would warrant the man getting a slap across the face, because it not only is insulting, but also reminds women of the days when they were considered inferior to men. This attitude exists particularly in Western culture where women are considered equal to men (even still, discrepancies exist, particularly in positions of power and politics). In many Islamic countries, however, this kind of deprecating behavior towards women is acceptable to the point that a woman basically becomes her husbands property. Calling someone hey woman would certainly not be regarded as derogatory or insulting by the majority of the people in these countries (e. g. Afghanistan, Iran, Iraq, Pakistan). For the women there, such behavior is acceptable because it is tolerated within their culture. The word itself is simply another label that describes who they are. In a culture that believes that women are inferior to men, sexism towards women in language would be common. Three centuries ago, the same attitude would hold true in Western civilizations as few women could hope to rise above the system and hold a position other than that of a housewife. It had been a belief that too much learning for women would result in evil. Thus, women often obtained an education only to the third grade level. Since society had deemed this acceptable and even necessary back then, calling someone woman would not be as offensive as it would be today. Though the word has remained unchanged, the connotation it carries differs greatly as a result in cultural changes. The number of languages one knows also reflects on the level of cultural awareness one has. The more languages one knows, the more likely it is he/she will have a deeper sense of the various cultures that exist in the world. Being bilingual in Chinese and English, I am able to understand Chinese culture better than someone who does not know the language because my view of the Chinese culture and traditions is subject only to my own interpretation, rather than that of a tour guide, publisher, author or another individual. I am an American Indian :: Personal Narrative

I am an American Indian My life has been put before me like a movie; the script unfolds and guides me through every stage, each act. I was born into an Indian world. From the beginning, I shared with my family, my mother’s family. My father had left my mother, who is 5/8 California Indian, soon after I was born. I grew up without a real father, and only recently have I realized how much I hate that fact. I was born in the hallway of a hospital in the Bay Area. Even then it seems that I wanted to do things my way. It was the beginning of my strangely unique life. Many of the things that have happened to me sound like a story from the mind of a lunatic. I remember the best times were spent with my sister and my mother when I was around four or five and we lived in Truckee. Bridgette was doing cartwheels on the lawn and she got bee-stings on her hands and feet. Dad was gone by then and we lived in Village Green in the trailer. One morning mom told us that Indians never went out looking for eggs and that Easter is really supposed to be about this guy named Jesus—he died, or was born, or came back to life or something important like that on that day a long time ago. We colored eggs anyway for fun. I was very talkative and strong headed—friends with everyone. Old Gladys and Ernie lived next door to my grandparents, just down the street from us in Village Green. I would catch Ernie when he came home from working in the woods with my grandpa and I would see if he saved me any goodies from his lunch. I would eat anything. He usually saved me something sweet; maybe Gladys knew and put it in his black metal lunch box just for me. Those are secrets that I will never know. They passed away with Gladys a few years ago, probably earlier since she had developed Alzheimer’s disease. The old folks—they sometimes take it with them. The trailer park was not near a reservation; Washos never got a recognized land base when they were pushed out of their homeland.

C. Vann Woodward's The Strange Career Of Jim Crow C. Vann Woodward illuminates one of the â€Å"ugliest† aspects of American societal history in his book The Strange Career of Jim Crow. His book is an overview of the development of the Jim Crow system, a set of racist laws put in place around the turn of the nineteenth century. Interestingly his book tracks the evolution of racism throughout American history. He not only shows where and when racism is developing but the different ways that the racism manifested itself in the North and South. C. Vann Woodward published the first edition of his book in 1955, while the racial atmosphere was in a tumultuous state. Black Americans at the time were still suffering from the effects of the Supreme Court Decision Plessy vs. Ferguson from 1896, the â€Å"separate but equal† distinction of the law. His book is published in the heat of these debates and racial struggle, posing the question how complete his book could be. He then republishes the book three more times, his second revised edition was published in 1966, his third in 1974, and the last in 2001. The book is based on lectures which he delivered at the University of Virginia in 1954. With every revision, he includes more evidence for arguments and responds to literary criticism. With the Civil Rights Movement raging around him, Woodward sought to explain the way the environment had come to be the way it was. In 1955 the Montgomery bus boycott was occurring as Woodward’s book was being published. With his first edition of the book, some of the most notable events of the civil rights movement had not yet occurred, Rosa Parks had not refused to give up her seat on the bus, the desegregation of schools was just beginning, and Martin ... ...at they could and they dealt with what they couldn't. The most interesting thing that Woodward does in his book is that he keeps perspective and he makes sure that he includes as much up to date information as possible. He is careful to keep his own personal opinions in perspective and bases most of the book on research. C. Vann Woodward himself comes from a background where he has dealt with much of what he writes about and he does not let his prior experiences interfere with his work. While he responds to the criticisms of his work he does not attack people he addresses the ideas. He uses many reliable sources from historical documents to his contemporaries. He gives both sides to every argument and point that he makes and he is very thorough. While he does not keep his opinions completely out of the book he includes his opposition and their opinions as well.

Mitch Alboms Tuesdays with Morrie :: Essays Papers

My Tuesdays with Morrie Mitch Albom, author of Tuesdays with Morrie, is flipping through his TV stations one night and he heard these words come from his TV set- â€Å"Who is Morrie Schwartz?†- And Mitch went numb. Mitch found out through the TV show â€Å"Nightline† that his life long friend and teacher is dying and Mitch knows that he has to go and see him. Mitch goes to see his old college professor and what starts out as a one-day meeting turns into a four-month â€Å"class†. The class is conducted in Morrie’s house in the suburb or Boston, there is no books or any other students, just Mitch and Morrie. Throughout this class Morrie teaches Mitch the lessons of life; lessons such as death, fear, aging, greed, marriage, family, society, forgiveness, and a meaningful life. As Morrie’s conditions worsen, Mitch’s condition is getting better, Mitch is becoming a better person with the help of Morrie. Finally Morrie’s life comes to an end, and Mitch graduates from Life 101. â€Å"I felt the seeds of death inside his shriveling frame, and as I laid him in his chair, adjusting his head on the pillow, I had the coldest realization that our time was running out.† (Pg. 59) That is what Mitch, a journal writer for the Detroit Free Press, said as he lifted his old college teacher from his wheelchair to his recliner. His old college teacher is Morrie Schwartz, a man that is dying from ALS otherwise known as Lou Gehrig disease. As the book goes on, Morrie reaches out to people who want to talk and he teaches them about the real lessons of life, while he is lying on his deathbed. Tuesdays With Morrie is an excellent book because Morrie teaches Mitch lessons about marriage, greed, and family that young adults can learn from. â€Å"Love each other or perish†. This quote sums up all of Morrie’s views and beliefs on the topic of marriage and love. This statement says a lot and I feel that young adults can learn a very big lesson from this short quote. Love and marriage are very important because we all need someone to love and to love back, if we don’t we are going to live a very lonely and unhappy life. There is a set of â€Å"rules† that Morrie stated in this book that I feel young adults could learn a lot from.

CYPOP 7 – Promote creativity and creative learning in young children 1.1 – Analyse the differences between creative learning and creativity Creative learning is about how children are actively involved in their own learning and their ability to make choices and decisions. This can be achieved by providing a creative environment, allowing exploration through play and praising the child’s creative efforts. Creative learning is about helping children develop imaginative thinking through exploration of materials, objects and problem solving skills like ICT. It is also about giving children opportunities to make connections between different areas and to relate to them. Some creative learning activities may be goal orientated like the goal is to make any painting they like, but the child will also be exploring the different colours given to them; to paint like colours can be mixed to make another colour. This activity will also help the child in other areas of learning too. Creative learning is about children using their mind to solve problems. Creativity is about risk taking and making connections, allowing children to explore and express themselves through a variety of media and materials. Like through dance, music, making things and drawing. A child being creative is linked to play and can develop through a child being engaged in their own actions and ideas. Creativity consists of traditional arts and the development of imagination and imaginative play, like role play and small world play. Creativity is about exploring emotions and expressions; also is about enjoying creativity and learning from the process. Creativity links to creative development areas of the learning from the EYFS. 1.2 – Explain current theoretical approaches to creativity and creative learning in early childhood There are many theoretical approaches to creativity and creative learning these are nature verses nurture this could mean that people are born with it or they learn it from life or other people. Nature versus nurture is a debate in the area of psychology. In terms of children’s  creativity, some think children are born naturally creative, for example having a gift for music or having a creative personality. This is known as the â€Å"nature† theory. Others believe creativity is something that can be taught. This is known as the â€Å"nurture† theory. The cultural approach means that every child will be creative so many things will affect this. As practitioners you have to give the child the right environment that will help children to explore and be creative with how they want to be. Cognitive theories is when children make relations between different things, this theory look at how the brain puts things together, lots of opportunities need to be provided for the child to develop knowledge in lots of different areas, and so that they can draw on their own views and experiences. Some theorists such as Robert Sternberg and Howard Gardener argue that being able to make new connections and to create a drawing from them is a type of intelligence. The ‘Creative Partnerships’ programme was set up in 2002 by the government in response to the influential report ‘all our futures’. They use the term ‘creative learning’ to try and sum up their education programme. They believe creative partnerships can help free the creativity of everyone involved by engaging them in fresh approaches to learning through partnership. Emotionally they learn how to manage frustration if something is not going to plan and they feel happy and proud and a sense of achievement when something is completed by them. Socially children can build up self-confidence by working with others or alongside them; to make something to share with everyone and the child also makes new friends. Intellectually children learn about problem solving, numeracy and developing their reading and writing skills. Children’s capability to communicate with peers and adults develops through creative play as well as their overall speech and listening skills. Physically, creativity can help develop fine motor skills by children using materials such as crayons, paints and sticking. Participating in movement activities such as dance or drama (role play) also improves the child’s overall physical development. Like during a cooking activity children are learning many skills through this creative process, they may feel happy and excited about making their own food. They are sociable by working with adults to support them and cooking for their friends or family members. By following instructions either written or verbal and measuring quantities they are developing intellectually. Knowing when to ask for help and starting a conversation around what they are doing and using can help develop their communication skills especially listening and taking direction. Finally all the mixing, chopping, kneading and picking up small cut up pieces, help the child develop physically developing the fine motor skills, hand eye co-ordination and building hand and arm muscles. The EYFS ensures that creativity and critical thinking are developed through play- based learning across the curriculum, and that children learn in an environment encouraging exploration and active and playful learning. It reflects the viewpoint that play offers significant benefits for children’s cognitive, emotional, social and physical development and is central to creativity.

The Place You Most Loved to Spend Time as a Child.

? Topic: The place you most loved to spend time as a child. Ma Vio's Kitchen Today, nineteen years after the passing of my grandmother, her kitchen looks the same with its walls in the same pastel orange and green she had painted it in so many years ago. The floral patterns that were done by my cousins and I using ochoes that she had cut in half and potatoes which she carved flowers from to make stamps that we gleefully dipped in containers of paint and placed on the wall hap-hazardly to form various patterns. I remembered her being so delighted in the end product that I don't think there was a neighbour, friend or visitor that my grandmother didn't boast to about her beautiful kitchen wall hat was so artfully decorated by her clearly talented grand children. I look at those walls to day and sometimes laugh at what persons out side of her family may have thought of her walls of art that anyone could have see were decorated by children all under the age of eleven. Walls that have been laquered to preserve what Ma Vio, as she was lovingly called by everyone, considered a ‘masterpiece that not even the most renowned of painters could have done with such perfection'. My fondest memories however, are not of the many different art projects that Ma Vio encouraged us into doing on her huge kitchen table but of the aromas drifting out of that little haven off of her livingroom. I remembered how she used to have these large bottles filled with all different types of homemade treats lined off on top of the kitchen counter†¦.. ed mangoes, stewed tamarind, tulum, benee balls, sugar cake, fudge you name it Ma Vio made it. Boy! Don't even get me started on her bread bin that never seemed to run out of mouth watering cakes and pastries†¦. coconut tarts, lemon bread, drops, peanut butter cookies and my favourite banana bread. Mmmhmmm †¦. I can smell it all now†¦. fresh out of the oven. Her pound cake and whole grain bread were what m y brother used to call ‘the bestest in all of Trinidad and Tobago', you couldn't find a bakery for miles with anything that good. You ever had homemade bread where you felt as if you had anything at all with it you'd spoil the taste? That's how everyone felt about Ma Vio's bread. It's good when accompanied by a filling but it's best when eaten by itself. Ma Vio's Kitchen smelled like christmas morning almost everyday as she was always busy making or baking something. “Dulce Et Decorum Est” by Wilfred Owen Essay

In the poem â€Å"Dulce Et Decorum Est†, by Wilfred Owen, Owen uses imagery and diction to convey the meaning of the poem. Throughout the poem, Owen paints visual pictures in the reader’s mind. His word choice also emphasizes what he is expressing in the poem. Diction and imagery are two literary devices that help the reader understand that they should feel sorrow and understand the intensity of war, the purpose of the poem. Owen puts a mental image in the reader’s mind, which is a picture of a war scene. The soldiers are trucking on â€Å"limped, blood shod† and through the treks. He is showing that the soldiers are injured and exhausted, which tells the reader they are at war. When Owen talks about the dream of the soldier plunging â€Å"at me, guttering, choking, drowning†, this paints a picture for the reader and sets a very intense mood because the soldier’s bad injury. Diction is used as well to convey the meaning of the poem. The soldiers are slouching on, â€Å"knock-kneed, coughing like hags, they cursed through sludge†. The reader wonders what is going on and sets the feeling of sorrow and sick feeling the reader should feel when reading Owen’s poem. When Owen explained the scene of the injured as â€Å"obscene as cancer, bitter as the cud, of vile, incurable sores of innocent tongues.† This makes the reader feel sorrow for the innocent soldiers and shows the awfulness of the war scene. Wilfred Owen, used word choice and mental pictures to set the mood for Dulce Et Decorum Est. Diction and imagery are two literary devices that can put purpose into words. As for Owen’s poem, the purpose was to make the reader understand the seriousness of war and sorrow for the soldiers.

The warmer climate thus increases risks of both drought and floods but at different places and times. In other instances, the saviour appears as a hunter or woodcutter to rescue the Little Red Riding Hood. The moral ambiguity in all the stories appear to focused on a human experience.
